Over the past few years, there has been a spurt of the telecom growth. Even though it has been in fits and starts. Envisaged in the National Telecom Policy was the role of a regulator. However, as the action on the ground has demonstrated, Telecom Regulatory Authority of India has clearly failed in its mandated role. The Indian telecom has had strange bedfellows. Department of Telecom was the regulator as well as the service provider. It made sure that its two very ugly daughters Bharat Sanchar Nigam Limited (BSNL) and Mahanagar Telecom Nigam Limited (MTNL) remained at the forefront of inefficiency.
TRAI was set up much later and it was envisaged to be a regulator and to safeguard the interests of the consumers. TRAI was in a bind and fix because most of the decisions that it ever took were either challenged in the courts or ignored. This has indeed limited its scope over the period of time whereby it cannot claim its mandate.
Seeing that a large number of cases were dragged to the court, the government of the day set up Telecom Disputes Appellate (TDSAT). TDSAT has however usurped the quasi-judicial powers of TRAI, which does not reflect a healthy regulatory regime.
Chief among the problems that TRAI is facing is the limited scope of its role in the market. Its method of financing wherein the telecom operators need to set aside 1% of their revenues for the same. There have many contentious issues of the fixed licensing fees whereby TRAI mandated them to shift to revenue sharing model. The license fee was unusually high which the GSM operators bid in, before they started their services. The setting up of Universal Service Obligation (USO) fund for subsidizing the telecom services in the rural areas. This has hung fire recently for the refusal of BSNL to expand its services. However, TRAI has been almost powerless to affect the spread of the telecom in areas where it has deemed to be important. Another area is the Access Deficit Charge, which BSNL has been claiming on dubious grounds. TRAI wants this to be phased out over a period of time wherein BSNL is not happy over the idea.
Over the past few years there have many task forces and committees to look into the spread of telecom in unviable areas. One such dealt with the need for the broadband access since the optic fiber has reach in most parts of the country.
TRAI s scope has been limited to procedural matters and some say cynically that the regulator is just an address in New Delhi. However, matters came to head when the broadband policy was announced. Most of the recommendations of TRAI were ignored in the best interests of BSNL. They had envisaged tax holidays and opening up of the local loop to private players. This evidently did not happen and TRAI was left twiddling its thumbs.
In this backdrop, the regulatory regime is ineffectual. Or rather, it has made to be one. This is the main reason why infrastructure funds are not flowing in the sector in a manner they ought to be.
There is a clear reason behind this. As the foregoing account goes, the telecom policy has been changed to suit a few people depending on the proximity of those people in the corridors of power. Reliance got license to start telecom services only as limited mobility clause. However, they announced roaming for the customers in the name of call divert. This obviously hurt the businesses of the GSM operators. TRAI could not really affect Reliance since technically speaking there was not any violation of the license. Paying a paltry sum as compared to the GSM operators, Reliance finally managed to get a unified license for its services and hence started offering full-fledged mobile services.
This kind of twisting of the laid down policy does not really enthuse the investor who would clearly investing his money on a long-term basis. Typically, infrastructure funds remain locked up on a long-term basis. This means that banks typically would not be able to offer the funds anyway. This indeed calls for a radical overhaul of the investment climate. There is a talk of using our bulging foreign reserves for the same purpose. However, at the point of repetition TRAI’s role needs to be clearly defined, as well as, clearly mandated for any dispute resolution. It also needs to be armed with more powers than it is currently now. For example, it could cancel the license of any operator who has flouted its regulations. This argument should hold true for BSNL! In the name of national interest, they have made sure that most of the consumers cannot reap the benefits of a robust telecom regime.

It clearly indicates non exposedure to the various brodband markets. Which is again laminated with the use of old technology like ATM network for the broadband service, so the obvious result is inefficiency.

I had taken a cellphone connection from Matrix telecommunications for use in US where i was proceeding for college education. Besides providing me with a non-working SMS service, i found that i had been billed for all the calls made to toll-free numbers in US. Even the calls made through calling cards had been charged for, making these calls doubly expensive as i was made to pay to both the calling card company as well as Matrix.
The toll-free number is supposed to be free for the caller and it is charged to the account of the number called.When thi was brought to the notice of Matrix they replied that the calls to tollfree numbers from their cell phone connection will be charged for.
I request you to inform me whether this is the correct position.
If it is the correct position than the TRAI must make it compulsory for all the establishments advertising their toll-free number, to duly inform the customer as to from which phone service the tollfree service is available. Is there anybody to check such mal=practices being carried out by Reliance.

It is also inform you that the service provider illegally disconnected againest the user manual page no 10,12,13,14,18,37,38 issued by them.in their advertisement shows the product is BIS quality but i could’t believe the product is a BIS quality. in these circumstances i may humbly request you to please take necessary action againest DISHTV,ASC ENTERPRISES,ESSEL HOUSE,DELHI 110035 (PH:01202445665,FAX 01202511181)to reinstate my digital reciever at the earliest.

i am a resident of Rohini, Delhi. my cable connection is provided by M/s sam world vision (tele.27947503). the monthly charges are Rs. 350/-. for the month of october also he charged the same amount. whereas it is understood that CAS is being introduced in delhi from 1.1.07, and as per TRAI press release the cable operators should reduce the charges to Rs. 200/- or so from 1.10.06. since the cable operator has not reduced the charges please advise me on the further course of action.

i have been using broadband, since March 2005, but since sept2005, time to time i am getting wrong bill from bsnl pune, while running from pillar to post i get bill corrected i have 8 wrong bill issued by bsnl, pune only when i pinpoint them of error they keep no sending wrong, may i know who is person to talk because i am sick and tired of wrong billing

We observed two things from Reliance Infocom Bills and these are as under:
1)They are billing for the services which are not requested as well it is requested in written to widraw these service but every month bill is coming with old dues and the continued service charges.
2)Bill is always rounded to next rupee whether it is 20 paisa or 42 paisa.
The above observations, clearly state that the reliance infocom is cheating with their prestigious consumers and they become big by befooling others.

I wanna bring to ur notice a serious problem that is now a taking place almost with all the mobile networks i.e is activation of dialer tones, dialer tones are been activated on our mobile without the proior notice of the customers and they are been charged around 50/- this is very bad iam a user of idea network in A.P. and this has happened not only with me but to some of my frnds also so i wanna to concerned authorities to take action on these type of matters where people are left with no choice but to shed the money from their pockets with out any notice.

I m subscriber of Reliance CDMA prepaid mobile with a plan of 2000 minuits free on reliance to reliance. I am facing a problem that when I recharge my mobile to call on other networks, my existing money(recharged) automatically collaps.
I connected to customer care and they reply that the money is being deducted against my sms and R-World usage. While I had never gone to use the R-world or made any sms because it has never been possible if I dont have money in my account. ON such a complain while they had deducted Rs 18/- and on my complain they returned only Rs.12/-.
This is not the matter of 10 or 20 rupees, u may imagine that Reliance co. is swallowing public money theftly in a smalll amound and there is no redresal of this. The representative again says that I have to pay Rs 50/- as a balace which is outstanding on me.

Though it has been passed almost 70 days I have not get my refund
I complained to company on 6th August by complaint no.80595037,I further complained on 9th August by complaint no 80984781,both the time I was colled that company will reply me within 24 working hours,but since now i have any reply by company.

I purchased a Post Paid connection under special oofer for Government Employees with exclusive 150 adv. rent at Rs. 799/- fro two years. the connection was given to me with Number : 9818794707, on13.07.2007. from AIRTEL. I started the phone on 15.08.2007 and discarded my onother phone after this phone was activated. two days later i started getting messages that i connot make phone calls from this number due to non payment of bills.
after making many request to the agen Mr. Iqbal singh : 9810212267, i came to know on 21.08.07 that my verification has not been confirmed and has failed. i made many calls to the the customer care sevice to find out the reason but to no avil.
even the staff at the customer care misbehaved with me specially. Mr. suryakant 9818899412, and the manager on duty on 22.08.2007 between 6.00 — 6.30 P.M.
on 22.08.07 bet. 3.00 — 4.00 p.m i got two sms messages confirming the payment of Rs. 799/- yet the phone has not been avtivated.

Every day I have to contact their service no 40161616 at B’lore and after three oe four hours of complaining connection will be set right. Connection will be perticularly off during day hours [9am to 4pm ie Stock market trading hours] Hence having this connection has become useless for me. I have spent atleast Rs 300 to 400 on telephone calls and paid about Rs 500 to Browsing center. I feel the system is overloaded hence our connections are disconnected to benefit the commercial consumers. I hope the regulaatory authority takes immediate action on this deriliction of service. I have the record of interuptions and the complaints regd Which will be produced before trhe authority if Enquiry were to be conducted and compensate for my loss. Expecting early response MPS

FIRST OF ALL THANK YOU FOR READING THIS E-MAIL,
SIR I HAD BROUGHT AN AIRTEL SIM HAVING COST OF Rs.700 WITH 2 YEAR VALIDITY AND Rs.2500 AIRTEL TO AIRTEL BALANCE.I HAD SUBMITTED ALL MY DOCUMENTS WHICH THEY TOLD ME TO.AS I M FROM DELHI AND NOW STUDYING FROM DEHRADUN AND DON’T HAVE RELATIVES HERE SO I SUBMITTED MY BONAFIDE CERTIFICATE AND COLLEGE ID CARD PHOTOSTAT WITH ADDRESS OF COLLEGE HOSTEL.THE SIM WAS FINE FOR 1 AND HALF MONTHS BUT WHEN I WAS GONE TO DELHI FOR CELEBRATING DIWALI THE SIM STOPS WORKING AS ALL MY INCOMING, OUTGOING CALLS EVEN MESSEGES WERE BLOCKED.WHEN I CAME BACK TO DDUN MY OUTGOING CALLS GET ACTIVATED.ABT WHICH WHEN I TALKED TO THE AIRTEL OFFICE THEY TOLD ME SUBMIT THE DOCUMENTS AS ADDRESS PROOF ONCE MORE SO I DID AS THEY SAID TO ME BUT AFTER 2 DAYS MY NUMBER WAS DEACTIVATED OR DELETED PERMANANTLY WITHOUT INFORMING ME AND THE REASONS THEY TOLD ME IS WRONG ADDRESS VERIFICATION WHICH CAN’T B POSSIBLE AS ONCE THEY CALLED ME IN MY DELETED NUMBER TO VERIFY THE ADDRESS BETWEEN MY LECTURES BUT I ATTENDED THE CALL AND TOLD THE ADDRESS.NOW EVEN THE AREA MANAGER IS REFUSING TO TAKE AN ACTOIN AGAINST IT

I HAD PURCHASED AN AIRTEL CONNECTION WITH NO. 9897474785 WORTH Rs. 700 WITH A 2 YEAR VALIDITY AND Rs.2500 AIRTEL TO AIRTEL BALANCE.AS I M FROM DELHI AND NOW STUDYING FROM DEHRADUN SO I PURCHASED THE SIM FROM DEHRADUN AS I LIVE IN THE HOSTEL OF MY COLLEGE SO I SUBMITTED THE ADDRESS PROOF OF HOSTEL IN MY ID CARD OF COLLEGE WITH A BONAFIDE CERTIFICATE FROM COLLEGE.THE SIM WAS FINE FOR 2 MONTHS BEFORE I CAME TO DELHI FOR CELEBRATING DIWALI WHERE MY OUTGOING AND INCOMING CALLS GET BLOCKED WITHOUT ANY INFORMATION.WHEN I CAME BACK TO DEHRADUN I ASKED ABOUT IT TO THE AIRTEL OFFICE NEAR CHICH CHOCOLATE,CLOCKTOWER THEY TOLD ME TO SUBMIT THE DOCUMENTS ONCE MORE SO I DID THE SAME BUT NOW MY NUMBER IS DELETED OR DEACTIVATED COMPLETELY. AND NOW EVEN THE AIRTEL AREA MANAGER IS REFUSING ME ABT IT SAYING THAT MY ADDRESS VERIFICATION HAS FAILED.THEY HAD WASTED A LOT OF MY TIME AND MONEY
SO, PLEASE IF YOU HAVE READ THIS TAKE A VERY STRICT ACTION AGAINST THEM AS POSSIBLE

we are recived complaint from manjeshwar exchange J.E.Mr.thamban,foulted number 04998272270,this number faulted from a week, when e recived complaint we are rang up to j.e. thamban to his mobile but we surprised to see the behavior of your j.e.and instead of controlling himself he is talking nonsense’s to us. he do not know how to perform the duty of j.e.. he was completely lost his temper and behaved un usual with us. He abused me in filthy language and threatened not to call again to us, so kindly we request with you, Disciplinary actions shall be taken against the concerned j.e.thamban; otherwise appropriate actions will be taken directly by the consumer’s of manjeshwar which may deem it in the future course of time

A complain was lodged to the “customercare@dishtv.in” regarding the status of subscription paid. with reference to VC no-”01504214176″.
An amount of Rs 3240/- was paid towards annual subscription on 28.11.2007.While the status is showing the amount has been paid for three months only.
The customer care fellow registered the complain no-10097930 dt 01.12.2007.
So far no redressal has been made by them.
You are requested to look into the matter.
